Ccma Collective Agreement

The Legal and Compliance Division or designated representatives may issue “compliance injunctions” requiring any person bound by a collective agreement to comply with the collective agreement within a specified period of time. The Board may refer to the CCMA any unresolved dispute concerning compliance with a provision of a collective agreement by an arbitrator designated by the Board or, where the dispute concerns a non-party. Arbitrators have the powers of the CCMA Commissioners and may order payment of any amount due under a collective agreement; impose fines for non-compliance with a collective agreement; to levy an arbitration fee or to require a party to pay the costs of the arbitration; confirm, vary or cancel a compliance order issued by a designated representative; or to award another appropriate distinction. Such appeals have the status of an order of the Labour Court.
